Introduction: SunStream Hotels & Resorts is offering this promotion open to SunStream.com and it’s affiliate resort property website users only. By participating in the Vacation Contest, each entrant fully and unconditionally agrees to and accepts these Official Rules. No purchase required to enter to win. Void where prohibited.
Eligibility: Open to SunStream.com and it’s affiliate resort property website users only who are at least 25 years of age. SunStream Hotels & Resorts, DiamondHead Beach Resort and their respective related companies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. Subject to all federal, state, provincial and local laws and regulations. Odds of winning in this drawing depend on the number of eligible entries received for the drawing.

Timing: The first weekly winner will be announced June 16, 2009. A winner will also be announced each week after June 16.
How to Enter: Go to http://www.SunStream.com and follow the links and instructions for entry. After you have submitted the required information, you will receive one (1) entry into the Contest. Contestants may enter as many times as they wish with a qualifying SunStream vacation photo.
For all entries: LIMIT: There are no limits to the number of entries accompanied by a qualified SunStream vacation photo.. All entries must be received online during the Promotion Period. All entries become the exclusive property of SunStream Hotels & Resorts, and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by SunStream Hotels & Resorts. SunStream Hotels & Resorts is not responsible for lost, late, incomplete, invalid, unintelligible, which will be disqualified. Use of any automated system to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
Judging: The Photo Contest judging will be conducted in accordance with these Official Rules. All judging will be conducted by SunStream Hotels & Resorts whose decisions as to the administration of the Contest and the selection of potential winners are final. Entrants selected must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. If a potential winner cannot be contacted within three days (72 hours) after the first attempt to contact him/her an alternate entrant will be selected in his/her place at random from among all eligible entries received.
Prize Restrictions:
· Prize is non-transferable and cannot be converted into cash
· Winners must be at least 25 years of age.
Publicity: Except where prohibited, participation in the Contest constitutes winner’s consent to SunStream Hotels & Resort’s use of winner’s name, photo submissions, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.
General Conditions: SunStream Hotels & Resorts reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond SunStream Hotels & Resort’s reasonable control impairs the integrity of the Contest, as determined by SunStream Hotels & Resorts in its sole discretion. In such event, SunStream Hotels & Resorts reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment. SunStream Hotels & Resorts reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Contest is a violation of criminal and civil law, and, should such an attempt be made, SunStream Hotels & Resorts reserves the right to seek damages from any such person to the fullest extent permitted by law. SunStream Hotels & Resort’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Release: By entering this Contest, entrant agrees to release and hold harmless, SunStream Hotels & Resorts, DiamondHead Beach Resort, each of their related companies, and each of their respective officers, directors, employees, and agents from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize.
Limitations of Liability: SunStream Hotels & Resorts is not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Contest; (iv) electronic or human error which may occur in the administration of the Contest or the processing of entries; or (v) any injury or damage to persons or property, including but not limited to entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest.
Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than the administration of the Contest or the determination of winners shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Winners List: Contest results and a copy of these Official Rules may be obtained by sending a self-addressed, stamped envelope to SunStream Hotels & Resort, Attn: SunStream Photo Contest, 6620 Estero Boulevard, Fort Myers Beach, FL 33931. Requests must be within thirty (30) days of the applicable drawing date.
